KATU Innovation Challenge
Official Rules
Description of Contest. The KATU Innovation Challenge (“Contest”) is a design challenge developed and administered by The Construct Foundation (“Construct”), and with participation by Sinclair Television of Portland, LLC dba KATU, solely as the media sponsor (“KATU”), and Portland General Electric Company, Intel Corporation, Daimler Trucks North America LLC and First Technology Federal Credit Union, as Contest sponsors (collectively, the “Sponsors”). The Contest is intended to promote STEM education with a strong focus on engaging girls and minorities. To enter, each Team must register for the Contest during the Registration Period, and submit a valid Submission during the Submission Period (as such terms are defined below). Up to six winning Teams will be chosen: (a) up to three winning middle school Teams grades 6-8, and (b) up to three winning high school Teams grades 9-12.
Eligibility. The Contest is open to legal U.S. residents (a) who reside in the State of Oregon or within the following counties in the State of Washington: Clark, Cowlitz, Klickitat, Skamania and Wahkiakum, (b) who are enrolled students in grades 6 through 12 (each, a “Student” and collectively the “Students”), and (c) for those Students under the age of 13, whose parents have provided Construct with verifiable consent (in accordance with Construct’s notice and request and the Children’s Online Privacy Protection Act (“COPPA”)) for Construct to collect personal information from the Student in connection with the Contest, and have not withdrawn such consent. Void where prohibited by law.
The following persons are not eligible to enter the Contest: Students who are children of (i) a member of the Judging Panel (as defined below), or (ii) an employee, officer, or director of Construct or KATU.
COPPA. Before a Student under the age of 13 may register for the Contest or submit a Submission for the Contest as described below (including as part of a Team), Construct must have received verifiable parental consent (in accordance with COPPA and Construct’s notice and request) for Construct to collect personal information from the Student in connection with the Contest. If a Student’s parent withdraws such consent at any time during the Contest, such Student will no longer be eligible under the Contest and must be removed from his or her Team. By registering for and/or submitting a Submission to the Contest, each Student under the age of 13, and such Student’s parents, acknowledge and agree that Construct, KATU the Sponsors and the Contest are in compliance with COPPA and its corresponding rules and regulations.
Registration and Submission Period. The registration period for the Contest begins on February 1st, 2022 at 12:01AM PST and ends on March 31st, 2022 at 11:59PM PST (“Registration Period”). For Teams that successfully registered during the Registration Period, the project submission period for the Contest begins on March 15th, 2022 at 12:01AM PST and ends on April 8th, 2022 at 11:59PM PST (“Submission Period”). To be eligible to win the Contest, Teams must (a) register for the Contest during the Registration Period and (b) submit a valid Submission (as defined below) through the Contest Page during the Submission Period. Construct’s computer, or its third party service provider’s computer, is the official timekeeping device for the Contest. Construct may cancel the Contest at any time. Chances of winning will depend on the number of eligible Submissions and the judges’ evaluation and scoring.
How to Enter. To enter the Contest, each Team (defined below) must: (a) visit the official Contest page at www.constructlearns.org/katuinnovation (the “Contest Page”); (b) register for the Contest by successfully completing and submitting the registration form on the Contest Page during the Registration Period; and (c) complete and submit an electronic Contest submission form, and upload all required materials and documents, as described on the Contest Page. The registration, completed submission form, and all required documents and materials, constitutes a “Submission.” The cost to make the Team’s prototype may not exceed $100. A “Team” is defined as up to four eligible Students identified in the Submission. A Team will be eligible to win a middle school Team prize for grades 6-8 if each Student on the Team is in grades 6-8 at the time of Submission. A Team will be eligible to win only a high school Team prize for grades 9-12 if any Student on the Team is in grades 9-12 at the time of Submission.
Multiple Submissions are not permitted by any Team, and Students are not permitted to enter Submissions with more than one Team. Students and Teams may not enter Submissions that contain designs or concepts that were previously submitted by such Student or Team in a previous Construct-led design challenge; any Submission containing previously-submitted designs or concepts will be disqualified.
Construct is not responsible for Submissions that are not received due to lost, failed, delayed, or interrupted connections or miscommunications, or other electronic malfunctions. Construct is not responsible for incorrect or inaccurate Submission information, whether caused by persons entering such information on the Contest Page, or by any of the equipment or programming associated with or utilized in the Contest, or by any human error which may occur in the processing of Contest Submissions. Submissions containing false or fraudulent information will be disqualified. Submissions remain the property of Construct and will not be returned or acknowledged.
By submitting a Submission, each Student and Team represents and warrants that they are the sole owner of the copyright of any Submission submitted, that all “moral rights” in the Submission have been waived, and that the Submission does not violate any intellectual property, publicity, privacy, or moral rights of any third party. Submissions may not contain material copyrighted by a third party. Each Submission is bound by and subject to the terms of these Official Rules and Construct’s privacy policy applicable to the Contest, available at: www.constructlearns.org/katuinnovation-privacypolicy.
Judging and Notification. After the Submission Period, select members of Construct and some or all of the Sponsors (the “Judging Panel”) will judge all Submissions based on the judging criteria available at www.constructlearns.org/katuinnovation-submissiondetails-judgingcriteria.
The Judging Panel will select up to 10 finalist Teams (five middle school Teams and five high school Teams) on or about April 15th, 2022. Each finalist Team will work with Construct-selected coaches to further develop and prepare its final Submission. Each finalist Team will present its final Submission to the Judging Panel at a pitch event on May 4th or May 5th, 2022.
After the pitch event, the Judging Panel will select, in its sole discretion, up to six winning Teams: (a) Construct will seek to award 1st prize, 2nd prize and 3rd prize to three winning middle school Teams grades 6-8, and (b) Construct will seek to award 1st prize, 2nd prize and 3rd prize to three winning high school Teams grades 9-12. Runner Ups (4th and 5th place) will also be selected and notified during this time (see prizes below). Winning Teams will be notified during the week of May 9, 2022, and will be publicly announced during a segment on select KATU and KUNP news and lifestyle programs on May 13, 2022. KATU and KUNP reserve the right to not air any particular segment or program, and any segment or program may be preempted due to breaking news or news of national importance.
All results are final and may not be appealed. Construct will notify the winning Teams via email. If a potential winning Team cannot be reached and/or does not respond to Construct within two days from Construct’s first attempt to contact the winning Team, or if the winning Team is found to be ineligible or does not otherwise comply with these Official Rules, an alternate winning Team may be selected by Construct.
Construct and the Judging Panel reserve the right to select fewer than 10 finalists and/or six winners in the event there are insufficient Submissions that, in the Judging Panel’s reasonable discretion, do not adequately meet the standards set in the judging criteria.
Prize. Each 1st prize Team will receive a $2,000 check. Each 2nd prize team will receive a $1,500 check. Each 3rd prize team will receive a $500 check. Each Runner Up Team (4th and 5th prizes) will receive a $250 check. Each Honorable Mention team (10 total, aside from the 10 Finalists) will receive a $100 check. Each prize, as described, will be awarded to the Team (and not to the Students), and the prize winnings shall be allocated among the Students on the winning Team as such Team sees fit in its sole discretion. Construct will make check out to the Team Lead denoted in the team registration form - Construct is not responsible for splitting winnings between team members.
No substitution, transfer, or cash equivalent of the prize is allowed by any winner. Construct, at its sole discretion, may substitute a prize of equal or greater value. Construct does not represent or warrant that any prize is fit for any particular purpose or use. Construct disclaims all warranties, express or implied, for the prize, including implied warranties of merchantability and fitness for a particular purpose. The prize is provided on an “as is” basis, and cannot be returned.
License. By submitting a Submission, each Student and Team grants to Construct, KATU, Sponsors and their Affiliates a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, transmit and display the Submission, and to incorporate the Submission into any other works in any form, media or technology now known or developed in the future, and Construct, KATU, and Sponsors may use or disclose the Submission for any purpose, including without limitation developing, manufacturing and marketing goods and/or services. Construct, KATU, and Sponsors have the right, but not the obligation, to use, distribute, or exploit any Submission.
Each Submission into the Contest and/or acceptance of a prize constitutes permission for Construct, the Sponsors, KATU, and their Affiliates to use the Team’s and Student’s name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, unless prohibited by law.
General Conditions. All taxes are the sole responsibility of winners. Winners may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and/or a Publicity Release (collectively “Affidavit/Release”) which must be returned to and received by Construct within ten (10) days from winner’s receipt of the Affidavit/Release. Any failure to comply with the foregoing may result in disqualification and an alternate winner may be chosen. Return of the prize, the prize notification, or the Affidavit/Release as undeliverable may result in disqualification and an alternate winner may be selected. All entrants agree to comply with these Official Rules. Any person attempting to defraud or in any way tamper with this Contest, and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law.
THE STATE AND FEDERAL COURTS IN MULTNOMAH COUNTY, OREGON SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF OREGON SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
If, for reasons beyond Construct’s control, the Contest is not capable of running as originally planned, Construct reserves the right in its sole discretion to suspend, cancel or modify the Contest, without liability. Construct is not responsible for errors, failures or delays caused by Construct’s or any entrant’s computer system, hardware, or software.
Waivers and Disclaimers. All Contest entrants agree that none of Construct, KATU, Sponsors and their Affiliates shall be liable for, and all Contest entrants hereby waive, any claims for losses or injuries of any kind resulting from the Contest, participation in the Contest, or Contest prizes. KATU is acting solely as a media sponsor and is not a Contest sponsor or administrator.
